Introduction
Welcome to Spotless Hygiene. These Terms and Conditions govern all services provided by us. By accepting our Quote (verbally, electronically, or in writing), you agree to these Terms.
Services and Quotes
- Acceptance: Acceptance of our Quote confirms agreement to these Terms.
- Scope of Work: We will carry out the services outlined in the Quote.
- Pricing: All prices are inclusive of GST unless otherwise stated.
- Validity: Quotes are valid for 30 days from the issue date.
- Variations: Any additional or unforeseen work will be discussed and may incur extra charges.
Client Responsibilities
- You must provide safe and clear access to all areas requiring service.
- All vehicles, furniture, and obstacles must be removed prior to service.
- Pets must be secured.
- You must inform us of any known hazards, fragile areas, or sensitive surfaces before work begins.
- You are responsible for ensuring the property is weather-tight and properly maintained.
Nature of Soft Washing Services
- Our services involve the use of low-pressure washing and specialised cleaning solutions.
- Results may vary depending on the condition, age, and type of surface.
- We do not guarantee complete removal of all stains, mould, or contaminants.
- Some treatments may continue working after completion, and results may improve over time.
Pre-Existing Conditions
- We are not responsible for damage resulting from pre-existing conditions, including but not limited to:
- Cracked or peeling paint
- Deteriorated or brittle materials
- Loose fittings or surfaces
- Prior water damage or poor maintenance
- Cleaning may reveal or worsen these conditions.
Water Ingress
- While reasonable care is taken, Spotless Hygiene is not liable for water ingress caused by:
- Faulty seals
- Damaged cladding
- Poor waterproofing
- Structural defects
Chemicals and Surroundings
- Our services use cleaning agents designed for exterior cleaning.
- While we take precautions, we are not responsible for damage to plants, materials, or surfaces unless caused by negligence.
- Clients must notify us of any delicate or sensitive areas prior to service.
Weather Conditions
- Services are dependent on suitable weather conditions.
- We reserve the right to reschedule due to rain, wind, or other unsafe conditions.
- We are not liable for delays caused by weather.
Completion and Complaints
- Services are considered complete upon our departure from the site unless otherwise agreed.
- Any concerns must be raised within 24 hours of service completion.
- You are responsible for inspecting the work upon completion.
Payment Terms
- Payment is due in full upon completion unless otherwise agreed.
- Preferred payment methods: bank transfer or cash.
- Late payments may incur interest at a reasonable commercial rate.
- Any costs associated with debt recovery will be payable by the client.
Consumer Rights
- Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 where applicable.
- If services are supplied for business purposes, the Consumer Guarantees Act does not apply.
Limitation of Liability
- Our liability is limited to the value of the services provided.
- We are not liable for any indirect, incidental, or consequential losses.
Force Majeure
- We are not responsible for delays or failure to perform services due to events beyond our control, including weather, equipment failure, or supply disruptions.
Ownership of Goods
- Any goods supplied remain the property of Spotless Hygiene until paid for in full.
Privacy
- We may collect and use your information in accordance with the Privacy Act 2020, including for credit checks and debt recovery if required.
Dispute Resolution
- Any disputes will be addressed in good faith through direct communication before any formal action is taken.
General
- These Terms are governed by the laws of New Zealand.
- We reserve the right to update these Terms at any time.
