Introduction Welcome to Spotless Hygiene! The following Terms and Conditions govern our services and your engagement with us. By receiving or signing our Quote, you agree to these Terms and Conditions.
Services and Quote
- Acceptance: Acceptance of our Quote signifies your agreement to these Terms and Conditions.
- Services: Spotless Hygiene will perform the services described in the Quote.
- Pricing: All prices are inclusive of GST, unless stated otherwise.
Client Obligations
- Information and Access: You must provide all necessary information and access for Spotless Hygiene to perform the Services.
Complaints and Completion
- Complaints: Any complaints must be made at the time of service completion.
- Completion Acknowledgement: You accept that the Services are complete when Spotless Hygiene leaves your premises. It's your responsibility to review the Services upon completion.
Payment Terms
- Payment Upon Completion: Payment is required in full upon completion of the Services, unless otherwise agreed.
- Preferred Payment Methods: We prefer payment via Direct Bank Transfer or cash.
- Late Payment: If payment is delayed, interest may accrue at a reasonable rate in line with market norms.
- Debt Recovery: Costs incurred in enforcing payment will be your responsibility.
Consumer Rights
- Consumer Guarantees Act 1993: Where applicable, your rights under this Act are recognized and will not be limited.
- Business Customers: If the Services are for business purposes, the Consumer Guarantees Act 1993 does not apply.
Liability
- Limitation of Liability: Spotless Hygiene's liability is limited to direct damages and will not exceed the amount you paid for the services.
- Exclusions: We are not liable for indirect or consequential losses.
Unforeseen Circumstances
- Force Majeure: We are not liable for delays or failures in service due to circumstances beyond our reasonable control.
Additional Provisions
- Validity of Quote: Quotes are valid for 30 days from the issue date.
- Unforeseen Work: Additional charges may apply for unforeseen work, subject to your consultation.
- Goods and Ownership: We retain ownership of any Goods until full payment is made.
- Intellectual Property: Designs created by us remain our intellectual property.
Dispute Resolution
- Resolving Disputes: Any disputes will be resolved amicably through direct communication.
General
- Jurisdiction: These Terms and Conditions are governed by New Zealand law.
- Data Disclosure: We may disclose your information for credit references or debt collection as per the Privacy Act 2020.
- Amendments: We reserve the right to amend these Terms and Conditions.
